Uber Attempts to Limit Liability with Bike Share

Uber is facing pushback in Staten Island regarding a proposed measure to limit liability in its very popular bike share program.

According to POLITICO sources, Uber wants to insert "forced arbitration" policies into the user agreements preventing riders from seeking relief in court when something goes wrong with the service. New York mayor de Blasio is pushing back with support from presidential candidate Elizabeth Warren and House Judiciary Chairman Jerry Nadler who introduced a bill that would ban forced arbitration clauses saying it would help "the little guy against giant corporations."

City precedent is unclear because while Uber's competitor LYFT, who has a headstart on bike sharing in New York City, doesn't have a forced arbitration clause in their agreements, it does have provisions that inhibit the process considerably. 

Uber's bike share future expansion is in question while the conflict plays out, but in the meantime, Uber will continue to offer bike sharing while negotiations endure. 

"Bikes remain active while we try and find a way forward that works for everyone," said Uber spokesperson Harry Hartfield.

David Seligman, the executive director of a worker advocacy group, was blunter. 

"If the city is going to license Uber bike, it needs to know there are problems with Uber bike."
